As the number of satellites orbiting Earth continues to grow, so does the risk of crashes between these spacecraft. Such collisions could create fields of debris, potentially rendering entire areas of orbit useless, reports BritPanorama.

Though objects in space have experienced crashes or near misses in the past, incidents remain rare. Currently, there are over 18,000 active and inactive satellites in orbit, a number that has more than doubled in the last six years. The majority of these satellites are positioned in low-Earth orbit, where congestion is increasing the likelihood of collisions.

The U.S. Federal Communications Commission (FCC) is contemplating a new set of rules, which is largely supported by the industry, aiming to “modernize” satellite approval processes and enhance “space safety” provisions. The proposed regulations would require satellite operators to share real-time tracking data, enabling space traffic managers to obtain a comprehensive understanding of orbital activity. Historically, predicting potential collisions has been exceptionally challenging.

While many support the proposed FCC rules, they have sparked a debate about regulatory authority over space management. The FCC has acted as the primary satellite regulator for decades, owing to its power to manage radio spectrum used for data transmission. However, as the commercial space industry expands, some lawmakers advocate transferring regulatory oversight to the Department of Commerce, arguing that it could support the sector more effectively and help maintain U.S. competitiveness in the global space industry.

Support for this transition spans both political parties. On the House Science Committee, Republican Brian Babin and Democrat Zoe Lofgren recently urged the FCC to reconsider or amend its rules, asserting that federal law does not grant it adequate authority over space safety and traffic management. The FCC has yet to respond to this call or provide comments on the matter.

Despite the pushback, the FCC may still proceed with the vote to adopt the new space traffic rules, slated for Wednesday. A follow-up letter from Babin and Lofgren suggested postponing the vote and engaging lawmakers before moving forward.

This ongoing regulatory dynamic underscores the rapidly evolving space sector, with companies like SpaceX, OneWeb, and Amazon launching hundreds—if not thousands—of new satellites amid questions regarding the authority to oversee their operations.

Seeing the skies

Efforts to transfer regulatory authority to the Department of Commerce face challenges, particularly regarding funding for the agency’s expanded responsibilities. The Department of Commerce did not respond to requests for comment regarding its role in space regulation.

Tom Stroup, president of the Satellite Industry Association, noted the industry is currently in a “gray area” concerning space sustainability and collision prevention. He emphasized the urgency of implementing measures as endeavors to populate space become increasingly ambitious—SpaceX plans to deploy upwards of 1 million satellites as part of its strategy for orbital data centers.

For satellite operators, the FCC’s proposed rules represent a significant step forward. However, paths diverge when it comes to how the Department of Commerce might introduce competing safety regulations if it assumes regulatory responsibilities.

In a letter to the FCC, Babin and Lofgren expressed concerns that the commission lacks the necessary power to regulate aspects of space safety. Meanwhile, industry representatives view the FCC’s approach favorably, recognizing it as a favorable first step in refining oversight within the sector.

The proposed changes come as satellite developers continue to argue that existing regulatory procedures impede progress. Today’s satellite market has transformed, necessitating a shift from the outdated framework that dominated in an era when barely a few satellites launched annually.

The FCC’s new rules aim to replace the previous, prescriptive satellite approval processes focused on rigid paperwork with more flexible, performance-based criteria. This revised approach is expected to significantly expedite the licensing process, which many industry professionals believe will particularly benefit smaller companies.

By easing the financial burdens associated with licensing, the regulations could reduce entry barriers for new entrants to the satellite market. Observers note that the clarity provided by the new regulations would enhance planning for satellite operators, facilitating growth in the burgeoning sector of space-based services.

As the frequency and scale of satellite operations increase, addressing space sustainability and safety becomes paramount, with stakeholders eagerly anticipating the FCC’s forthcoming decisions. The implications of such developments will resonate throughout the industry as it navigates this complex and evolving terrain.
